TERMS AND CONDITIONS FOR IBOM AI

Please read these Terms and Conditions ("Terms") carefully before using the Ibom AI platform, applications, websites, and its 31 flagship modules (collectively, the "Services") operated by Ibom AI ("us", "we", or "our").

By creating an account or accessing our Services, you agree to be bound by these Terms and all applicable laws in the Federal Republic of Nigeria. If you disagree with any part of these terms, you do not have permission to access the platform.

1. Eligibility and Account Security

  • Minimum Age: You must be at least 13 years old to use Ibom AI. If you are under 18, you must have the explicit supervision and consent of a parent or legal guardian who agrees to bound by these Terms.

  • Registration Integrity: You agree to provide accurate, current, and complete information during registration.

  • Account Custody: You are entirely responsible for safeguarding your login credentials. Any activity, API requests, or data submissions occurring under your account are deemed to be your sole responsibility. You must immediately notify us of any security breach or unauthorized access.

2. Content Ownership and Commercial Rights

  • Your Inputs: You retain all intellectual property rights, titles, and ownership over the data, text, code, prompts, or files you input into our modules ("Input").

  • The Outputs: Subject to your compliance with these Terms, Ibom AI assigns to you all its rights, title, and interest in and to the specific text, data, or media generated by the platform in response to your Input ("Output").

  • Commercial Freedom: You are fully permitted to use the Output for any lawful commercial purposes, including publishing, software deployment, business operations, and digital monetization.

  • Output Non-Uniqueness: Because of the nature of machine learning algorithms, similar prompts by different users may result in identical or similar responses. The assignment of Output rights applies only to your unique instance of generation; it does not grant exclusive rights over that content globally.

3. Acceptable Use and Ethical Restrictions

In line with safe, constructive, and ethical AI deployment, you explicitly agree not to use Ibom AI to:

  • Deceive or Mislead: Represent that an Output from Ibom AI is entirely human-generated when it is not, particularly in academic, journalistic, or legal settings where disclosure is ethically required.

  • Infringe Proprietary Rights: Upload inputs that violate the patents, copyrights, or trademarks of any individual or corporate entity.

  • Scrape or Reverse Engineer: Utilize automated scrapers, bots, or programmatic scripts to harvest outputs or extract underlying model weights from our platform without our explicit written authorization via an official API.

  • Compete Unfairly: Use our outputs to train, fine-tune, or develop competing large language models or automated machine learning tools.

  • Harm System Integrity: Introduce malware, bypass system token limits, or engage in prompt-injection attacks designed to break the guardrails of the 31 flagship modules.

4. Financial Terms, Subscriptions, and Billing

  • Fees: Certain advanced or specialized tiers of Ibom AI require payment. All applicable subscription fees, enterprise rates, and taxes will be explicitly clearly stated prior to purchase.

  • Currency & Protection: In compliance with the FCCPC Act 2018, all pricing updates will be communicated transparently. Payments are processed via secure, third-party licensed payment gateways.

  • No Hidden Charges: We will never apply recurring charges to your account without your clear, affirmative consent and selection of a recurring subscription model.

5. Accuracy Disclaimer ("As-Is" Clause)

  • Nature of AI Outputs: Ibom AI utilizes highly advanced, specialized language models. However, AI can occasionally experience "hallucinations"—generating inaccurate, outdated, or incomplete information.

  • Verification: You are solely responsible for verifying the accuracy and viability of any Output before acting upon it, relying on it, or publishing it.

  • Professional Advice: Outputs generated by Ibom AI are for informational, creative, and operational assistance only. They do not constitute official medical, financial, legal, or professional advisory services.

  • Warranty Disclaimer: The platform is provided strictly on an "As-Is" and "As Available" basis. Ibom AI makes no warranties, express or implied, regarding the continuous availability, flawless accuracy, or perfect suitability of its outputs for specific industries.

6. Limitation of Liability

To the maximum extent permitted by Nigerian law, Ibom AI, its directors, employees, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including but not limited to loss of profits, data, goodwill, or operational business interruptions—resulting from:

  1. Your use of, or inability to use, the platform.

  2. Any reliance placed on the accuracy of the platform's outputs.

  3. Unauthorized access to your account due to credential negligence.

In no event shall our total aggregated liability for any claim under these terms exceed the total amount paid by you to Ibom AI for the specific service tier in question during the twelve (12) months prior to the claim.

7. Suspension and Termination

We reserve the right to suspend, throttle, or terminate your access to Ibom AI immediately, without prior notice, if:

  • You are found to be in material breach of any provision within these Terms.

  • Your account behavior is flagged by our security systems as malicious, abusive, or harmful to other users or our cloud infrastructure.

  • We are required to do so by a lawful directive from a competent court or law enforcement agency in Nigeria.

You may also terminate these Terms at any time by simply closing your account and ceasing all usage of the platform.

8. Governing Law and Dispute Resolution

  • Jurisdiction: These Terms shall be governed, construed, and enforced in accordance with the laws of the Federal Republic of Nigeria.

  • Amicable Resolution: In the event of any dispute, controversy, or claim arising out of these Terms, the parties shall first attempt to resolve the matter amicably through good-faith direct negotiations.

  • Mediation and Arbitration: If an amicable settlement cannot be reached within thirty (30) business days, the dispute shall be referred to and finally resolved by arbitration or a recognized multi-door courthouse mediation framework within Nigeria, before resorting to litigation.

9. Modifications to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is significant, we will provide at least 14 days' notice via your registered email or a prominent platform dashboard notification before the new terms take effect. By continuing to access the service after revisions become effective, you agree to be bound by the updated terms.
